    • Some cited figures that were comparatively modest. Discussing an exchange in which a gentleman had asked him to testify, a Cornish blacksmith remembered having announced that he ‘would not saye [as requested] for all the good he was worthe’ - STAC 5/B84/15, Edward Richard (deposition). In the 1590s, a Cornish labourer recalled encountering a husbandman called John Symon. During their exchange, Symon was chained to the door of the town hall awaiting examination about various crimes (including perjury) that he may or may not have committed at a gentleman’s behest. The labourer asked: ‘“What, are you here yett? Have not you lost your eares yett?”’ Symon ‘laghed’ in response to the question. Given that his ears were subsequently cut off prior to his being hanged, his laugh might well be described as gallows humour. STAC 5/B84/15, John Hicke (deposition). • He may have been ill, but judging from Star Chamber cases of 1565 he was as factious and lawless as others of the Cornish gentry. In 1565 Sir William Godolphin accused him of forcibly evicting tenants from the Godolphin manor of Lelant and carrying off corn and other crops. Mohun denied violence, but his servants who had carted the corn deposed that he had promised to ‘bear them out’. In the same year a feud between him and John Killigrew came to a head. It is an indication of Mohun’s standing in the county that he dared to bring before the Council a long list of charges against Killigrew, who in general relied on his relatives at court to protect him from trouble. • STAC 5/H54/9 - B A C I D - 32 Eliz - Devon, Cornwall - John Harris, Joan Harris v Richard Connocke, Thomas Smith, et al
    • STAC 5/H54/9 cited in The History of Parliament, The House of Commons 1604-1629: Harris, John I, by Paul Hunneyball. “In 1589 Harris married a local heiress, Joan Harte, in controversial circumstances. She had only recently freed herself from an extended legal battle with another suitor, Nicholas Halse, who had alleged breach of promise of matrimony. Her lawyer, Richard Connock*, the son of a prominent Liskeard resident, subsequently claimed that he had also contracted to marry Joan once the Halse case was resolved, and accordingly sued her for compensation. Harris insisted that he had himself been promised Joan’s hand before Connock emerged as a rival, although in fact the wedding was held suspiciously soon after the death of her father, who seems to have favoured the lawyer’s candidacy.”

Herle v Winter

  • STAC 5/H77/33 - B - 10 Eliz - Cornwall - Thomas Herle v John Wynter, Jamys Tudie et al
    • In 1559 Herle succeeded to his family’s small patrimony as well as extensive lands which had been the inheritance of his mother. Five years later Elizabeth Carminowe’s estate was claimed by James Trewynnard, who had married Herle’s aunt Philippa. Herle denied that Trewynnard had any rights in the property, and he referred Keeper Bacon to a partition of Nicholas Carminowe’s lands some 20 years previously, under which certain lands had been allotted to Elizabeth Carminowe. The outcome of Herle’s appeal is not known, but it is almost certain that Trewynnard lost the case. Relations between the two men did not improve with time, as about 1569 Herle alleged in the Star Chamber that Trewynnard and accomplices had assaulted him and his servants, and entered his tinworks at Killifreth, and had taken away tin worth £50. J J Goring, ‘Herle, Thomas’ in History of Parliament Vols 1509-1558.

Herle v Collin

    • In 1581 Herle brought an … action in the same court [Star Chamber], this time against Thomas Stephens, who, he claimed, had attacked him and his family on their way back from matins at Probus church: this episode, it seems, was the culmination of a longstanding dispute regarding a right of way over Stephens’s land. J J Goring, ‘Herle, Thomas’ in History of Parliament Vols 1509-1558.
