  • Case Book BL Harley MS 2143 fo. 61v. Bill for lying in ambush and waylaying without mentioning matter of fact as assaulting, &c., to be dismissed. Jennings, plaintiff; Phillips et al, defendants. The defendants prayed to be dismissed for that the plaintiff had charged them in his bill with suppositions of matter of ambush or waylaying without making mention of any matter of fact as wounding or assaulting to be by them committed and the court ordered that if in the original bill the charge be so barely laid without the words wounding, assaulting or such like importing matter of fact then the same to be dismissed.
